How Long Do I Have To Resolve My Injury Claim in Indiana?

Generally, Indiana law allows two years from the date of the injury or damage to either resolve your claim with the person(s) responsible or have a lawsuit filed against that responsible person(s). There are exceptions to this rule for minors, persons deemed to be incompetent or incapacitated, etc. The best plan is to act quickly to make sure you preserve your rights.

Also, there is an additional requirement if your claim involves a governmental employee or governmental entity.  In those instances, Indiana law requires a Tort Claim Notice to be served upon the governmental entity or agency within 180 days or 270 days after the injury occurred, depending on the entity or agency.
